The Commercial Terms and Conditions for operating the e-shop on the web of Zámecké vinařství Bzenec

The e-shop is operated by Zámecké vinařství Bzenec s.r.o., company Reg. No. 47683295, with the registered office at Zámecká 1508, Bzenec, Czech Republic.

The operator of the e-shop and also the seller is Zámecké vinařství Bzenec s.r.o., company Reg. No. 47683295, with the registered office at Zámecká 1508, Bzenec, Czech Republic, recorded in the Commercial Register in Section C, Rider 52969, with the Commercial Court in Brno (hereinafter also referred to as the “Operator” or “Seller”).

These Commercial Terms and Conditions (hereinafter also referred to as the “Commercial Terms and Conditions”) apply to the purchase of wines, gift parcels of wines and accessories for sommeliers (hereinafter referred to as “Goods”) offered by the Seller through the Seller’s e-shop selling on the web www.zameckevinarstvi.cz operated by the Operator (hereinafter referred to as the “E-shop”).

In compliance with the provision of Section 1751 par. 1 of Act No. 89/2012 Coll., the Civil Code (hereinafter referred to as the “Civil Code”), these Commercial Terms and Conditions determine and specify the rights and obligations arising between the Seller and the Buyer (the Buyer and the Seller hereinafter jointly referred to as the “Contracting Parties”) especially when concluding a Sales Contract the subject-matter of which is the purchase of Goods offered by the Seller through the E-shop, concluded remotely (hereinafter referred to as a “Sales Contract”) and also the rights and obligations of the Contracting Parties connected with performance under the concluded Sales Contracts and the rights and obligations of the Contracting Parties when exercising rights arising out of the liability for defects in Goods.

The rights and obligations not regulated by these Commercial Terms and Conditions are governed by the relevant provisions of the Civil Code. If the Buyer is a consumer, the special consumer protection legal rules apply to the Seller-Buyer relation; they are contained especially in the Civil Code and Act No. 634/1992 Coll., on consumer protection.

The provisions of these Commercial Terms and Conditions are an integral part of a Sales Contract. A Sales Contract and the Commercial Terms and Conditions are made in the Czech language. A Sales Contract can be concluded in the Czech language.

Terms and conditions deviating from these Commercial Terms and Conditions can be agreed in an individually agreed Sales Contract. Any deviating provisions in a Sales Contract take precedence over the provisions of the Commercial Terms and Conditions.

The text of the Commercial Terms and Conditions can be altered or amended unilaterally by the Seller. The contractual relation between the Seller and the Buyer is always governed by the text valid and effective at the time when the Sales Contract was concluded between the Contracting Parties.

These Commercial Terms and Conditions exclude the sale of alcoholic beverages to persons under 18.

5 cartons (30 bottles) CZK 119.00

The prices for transport are given inclusive VAT.

For purchases over CZK 2,000, inclusive VAT, transport is FREE OF CHARGE for the Buyer.

In cash on collecting the Goods in person in the Seller’s corporate shop (by prior agreement only!)

The tax document will be included in the consignment. The method of payment of the purchase price of the Goods and other related costs is included in the Buyer’s Sales Contract.

- the Goods had the properties that had been agreed by the parties and if there was no such provision, the Goods had such properties that the Seller or the Buyer had described or that the Buyer expected with respect to the nature of the Goods and on the basis of the advertising carried out by them;

- the Goods were suitable for the purpose for which the Seller stated the use thereof or for which goods of such kind is usually used;

- the quality or performance of the Goods met the quality or design of the agreed sample or model if the quality or design were determined according to the agreed sample or model;

- the Goods were in the appropriate quality, rate or weight, and

- the Goods met the requirements of the legal regulations.
